Terms of Service

1. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age, are legally able to enter into binding contracts, and will comply with all applicable laws.

If using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. The Service

2.1 What we provide

We operate an AI aggregation service. We provide a user interface that routes your requests to AI language models through third-party service providers.

We route requests through intermediary services with Zero Data Retention (ZDR) policies, which connect only to AI providers who do not store your prompts or responses.

2.2 What we do not provide

We do not develop, train, or own AI models. We do not create AI outputs. We do not control AI capabilities or performance. We do not guarantee availability of any specific AI model.

2.3 Third-party dependencies

The Service utilizes third-party infrastructure providers, AI routing services, and AI model providers. Each has their own terms of service and privacy policies.

By using the Service, you acknowledge that:

• • We route requests through intermediary services that maintain Zero Data Retention (ZDR) policies
• • AI providers process your requests according to their own terms
• • You are bound by applicable third-party terms where relevant
• • We select providers based on privacy and security standards
• • You accept the risks inherent in using third-party services, including potential service interruptions, policy changes, or data handling practices beyond our control.

2.4 Our role

We are solely responsible for:

• • Our user interface and platform
• • Routing your requests to AI providers through privacy-preserving pathways
• • Maintaining anonymous access code system
• • Stripping identifying information before transmission

We are not responsible for:

• • Third-party infrastructure or service availability
• • AI model outputs or accuracy
• • Third-party data practices or policy changes
• • AI provider capabilities or limitations

2.5 Service modifications

We may modify, suspend, or discontinue the Service at any time without notice or liability.

2.6 Provider selection and changes

We continuously evaluate and select AI providers and infrastructure services based on:

• • Zero Data Retention commitments
• • Privacy and security standards
• • Model capabilities and availability
• • Cost and performance considerations

We may add, remove, or substitute providers at any time without notice. We are not liable for disruptions caused by provider changes.

3. Account

Your access to the Service is controlled by an anonymous access code. You are responsible for maintaining the security of your access code and for all activities that occur under it. You must notify us immediately at support@woltex.ai of any unauthorized access to your code.

Account Inactivity: Accounts with no activity for 12 consecutive months will be automatically suspended. Suspended accounts and all associated data may be permanently deleted.

Account Deletion: You may request permanent deletion of your account at any time by contacting support@woltex.ai. Deletion requests will be processed within 14 working days. All unused credits and data will be permanently deleted without refund.

Compromised Accounts: If your account is compromised, any unauthorized charges or usage are your responsibility. We are not liable for losses resulting from unauthorized access. Any remaining paid balance in a compromised account may be forfeited at our discretion to prevent fraud.

4. Prohibited Use

You may not use the Service:

For illegal activities:

• For any illegal purpose under any applicable law
• To engage in money laundering or process proceeds of crime
• To violate export controls or sanctions laws

For harmful content:

• To create content depicting or sexualizing minors
• To promote violence, terrorism, or self-harm
• To harass, threaten, or harm others
• To infringe intellectual property rights
• To violate privacy or spread personal information without consent
• For fraud or deception

To abuse the system:

• To reverse engineer or attempt to access source code
• To use automated tools without express written permission from us
• To circumvent security measures or usage limits
• To resell or sublicense access

Violations will result in immediate account termination without refund and may be reported to authorities.

5. Payment

Pricing: See our Pricing Page for current rates - all prices include applicable VAT/sales tax.

Payment methods: Credit/debit cards via Stripe; cryptocurrency via various processors.

Cryptocurrency payments: By paying with cryptocurrency, you acknowledge that we cannot verify the source of funds and you accept full responsibility for compliance with anti-money laundering laws. You warrant that the cryptocurrency was not obtained through any illegal activity including money laundering, fraud, or any other crime. We may refuse or reverse cryptocurrency payments at our sole discretion. Cryptocurrency payments are final and non-refundable.

Refund Policy: All payments are non-refundable except: (a) as required by applicable law, or (b) EU consumer 14-day withdrawal right for non-cryptocurrency payments as described in Section 13.

Tax Responsibility: All prices include applicable taxes. You are responsible for any additional taxes imposed by your jurisdiction.

Payment Disputes: Credit/debit card chargebacks and payment disputes are managed by Stripe in accordance with their terms of service. Initiating a chargeback may result in immediate account suspension pending resolution.

Account Credits: Account credits expire after 12 months of account inactivity. Upon account termination or deletion (whether by you or us), all unused credits are immediately forfeited without refund.

Payments are pre-paid credits only: We do not offer subscription auto-renewals. You must manually add credits to your account as needed, similar to a prepaid mobile phone service.

We may change prices at any time. Continued use after price changes constitutes acceptance of the new pricing.

6. Content Ownership

You retain ownership of your input. Output ownership is determined by the AI provider's terms, not these Terms. Different AI providers may have different ownership policies. You are responsible for reviewing the terms of service of the AI provider whose model generated any output you intend to use commercially or redistribute.

You are responsible for ensuring your use of outputs does not infringe third-party rights, including obtaining any necessary licenses or permissions.

We own the Service and all intellectual property in it. You may not use our trademarks without permission.

7. Feedback

If you provide bug reports or technical feedback to us, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use that feedback to improve the Service. Any feedback you provide is voluntary and will only include technical information necessary to address the reported issue.

We do not share individual user feedback, prompts, or outputs with third parties. Any information shared with service providers for operational purposes is limited to technical metadata necessary to provide the Service.

8. Monitoring

What We Store: We store your conversations, prompts, and artifacts encrypted on our servers to provide the Service (cross-device sync, search, organization). You control retention periods and can delete all data at any time.

Limited Monitoring: We collect only minimal metadata necessary to operate the Service:

• Account status (active/inactive)
• Credit balance and transaction history
• Service availability and performance metrics
• Security events and authentication attempts

What We Do NOT Do: We do not monitor, analyze, or use your data beyond service delivery:

• We never read your conversations or prompts
• We never analyze your usage patterns for profiling
• We never train AI models on your data
• We never sell or share your conversations with third parties

Legal Basis: Our collection of necessary metadata is based on our legitimate interests in providing the Service, maintaining security, preventing abuse, and complying with legal obligations. This processing does not override your fundamental rights under applicable data protection laws.

Data Retention:

• Conversations: Retained according to your chosen retention period (customizable from 1 day to indefinite)
• Metadata: Retained only as long as your account is active
• Deleted data: Purged from backups within 30 days after deletion request is processed
• Payment records: 7 years (tax law requirement, cannot be linked to conversations)

9. Termination

You may terminate your account at any time by requesting deletion through your account settings or by contacting support@woltex.ai. Deletion requests will be processed within 14 working days. No refunds will be provided.

We may terminate your account immediately for Terms violations, illegal activity, non-payment, or inactivity as described in Section 3.

Upon termination, your access ends immediately and we will delete your account data. You remain responsible for any violations of these Terms that occurred before termination.

10. Disclaimers

We provide the Service as described in Section 2. We route your requests to third-party AI providers through privacy-preserving intermediaries.

DISCLAIMER OF WARRANTIES:

To the maximum extent permitted by law, the Service is provided "as is" without warranties of any kind, express or implied.

We specifically disclaim:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties regarding AI output accuracy, completeness, or reliability
• Warranties regarding service availability, uptime, or uninterrupted access
• Warranties that third-party providers will maintain current policies or capabilities
• Warranties regarding the anonymity of your requests (beyond our direct control)

THIRD-PARTY SERVICE DISCLAIMER:

We are not responsible for:

• Performance, availability, or reliability of third-party infrastructure
• AI-generated outputs (created by third-party AI providers, not us)
• Service interruptions caused by third-party dependencies
• Third-party compliance with stated data retention policies
• Changes to third-party terms, pricing, or capabilities

AI OUTPUT DISCLAIMER:

AI-generated content may be:

• Inaccurate, incomplete, outdated, or misleading
• Biased, offensive, or harmful
• Subject to intellectual property claims by third parties
• Unsuitable for professional, medical, legal, or financial decisions

You use AI outputs entirely at your own risk. We recommend independent verification of critical information.

11. Limitation of Liability

Woltex will not be liable for any indirect, incidental, special, consequential, or exemplary damages, including damages for loss of profits, goodwill, use, or data or other losses, even if we have been advised of the possibility of such damages.

Our aggregate liability under these Terms will not exceed the greater of: (a) The amount you paid for the Service during the three (3) months before the liability arose, or (b) One hundred euros (€100).

These limitations apply only to the maximum extent permitted by applicable law and do not limit liability for death, personal injury, fraud, or other rights that cannot be excluded under mandatory consumer protection laws.

12. User Responsibility and Indemnification

Your Responsibility: You are solely responsible for all consequences arising from your use of the Service, including any legal claims, damages, or losses.

Indemnification: If you are a business or organization, to the extent permitted by law, you will indemnify and hold harmless Woltex, our service providers, and our personnel from any costs, losses, liabilities, and expenses (including reasonable attorneys' fees) from third-party claims arising from your use of the Service or violation of these Terms.

Exclusions: This indemnification does not apply to claims caused by security vulnerabilities in our Service or rights protected by mandatory consumer protection laws.

13. Governing Law and Dispute Resolution

Governing Law: These Terms are governed by the laws of Romania, subject to mandatory consumer protection laws applicable in your country of residence.

Jurisdiction:

• For business users and non-EU consumers: All disputes shall be subject to the exclusive jurisdiction of the courts of Romania.
• For EU consumers: You may bring proceedings in courts of your country of residence under EU law.

Optional Mediation: Before legal proceedings, you may contact us at support@woltex.ai to attempt informal resolution for 60 days. Mediation is voluntary and either party may withdraw at any time.

EU Online Dispute Resolution: EU consumers may access the EU ODR platform at: https://ec.europa.eu/consumers/odr

Consumer Rights: Nothing in these Terms limits your mandatory statutory rights under applicable consumer protection laws.

EU Consumer Withdrawal Right: If you are an EU consumer, you have a 14-day right to cancel paid services from the date of purchase. To exercise this right, contact us at support@woltex.ai.

For non-cryptocurrency payments: We will refund the unused portion of your credits within 14 days, minus any credits already consumed and payment processing fees. Refunds will be issued using your original payment method.

Cryptocurrency payments cannot be refunded due to the irreversible nature of blockchain transactions.

14. Modification of Terms

We may modify these Terms at any time.

Notice: When we update these Terms, you will receive an in-app notification requiring you to review and accept the updated Terms to continue using the Service.

Your Options:

• Accept: Click "I Accept" to continue using the Service
• Reject: Stop using the Service immediately

Changes become effective immediately upon your acceptance. If you do not accept within 30 days of notification, your access will be suspended.

No refunds are provided for rejection of updated Terms.

15. General

Assignment: You may not assign or transfer any rights or obligations under these Terms and any attempt to do so will be void. We may assign our rights or obligations under these Terms to any affiliate, subsidiary, or successor in interest of any business associated with our Services.

Entire Agreement: These Terms and our Privacy Policy contain the entire agreement between you and Woltex regarding the Service and supersede any prior or contemporaneous agreements.

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remainder remains in full force and effect.

No Waiver: Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.

Force Majeure: Neither party is liable for failure to perform due to circumstances beyond reasonable control, including natural disasters, war, terrorism, pandemics, and government actions.

Survival: Sections 4-13 and 15 survive termination of these Terms.

17. Acknowledgment

By using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. Specifically, you acknowledge and agree that:

• • You are at least 18 years of age and legally capable of entering into binding agreements
• • You accept these Terms in their entirety without modification
• • You understand the limited warranties and disclaimers set forth in Section 10
• • You assume all risks associated with using AI-generated content
• • You will use the Service only for lawful purposes
• • If paying with cryptocurrency, such funds were obtained through legal means
• • Disputes will be resolved under Romanian law and jurisdiction (subject to mandatory consumer protection laws)
• • All payments are final and non-refundable except as required by applicable law
• • Business users agree to the indemnification provisions in Section 12
• • We may modify these Terms at any time with notice through the Service
• • We may suspend or terminate your account at our discretion
• • We are not responsible for third-party services, AI outputs, or content accuracy
• • Our liability is limited to our user interface and routing services only
• • Account credits expire after 12 months of inactivity

If you do not agree to these Terms, you must not use the Service.
